Your use of the website and/or any purchases made from Ethelya are expressly and exclusively governed by (i) these Terms and Conditions and (ii) any other terms and conditions published or otherwise referenced on the website from time to time. Please note that these Terms and Conditions shall prevail over any other terms and conditions referenced in section (ii) above, except where expressly stated otherwise.

2. Products

Ethelya offers a variety of lab-grown diamond jewelry, including rings, necklaces, earrings, and bracelets. Customization services are also available.

Ethelya strives to ensure that its online catalog is as accurate and precise as possible. To allow detailed viewing of certain products, items may appear larger or smaller than their actual size. Variations in color may also occur due to differences in device settings.

We aim to provide comprehensive information to give you a clear understanding of your product before purchase. However, the displayed stone weight may vary by 0.1 carat from the actual weight. As our jewelry is handcrafted, some dimensions listed on product pages may slightly differ from the final item delivered.

3. Pricing and Payment

Prices displayed on the website include VAT. Accepted payment methods include credit cards. Payment plans are available.

The prices of products and promotional offers displayed on the website are valid as long as they are visible online, and subject to availability. Ethelya reserves the right to change prices and offers at any time, without prior notice.

Prices and information displayed on the website may contain errors due to system issues or typographical mistakes. While we make every effort to avoid such errors, they may occur. Orders based on incorrect pricing will not be honored.

If the displayed price is lower than the actual price, we will contact you via email to either cancel the order or provide instructions for paying the price difference. We apologize for any inconvenience this may cause. For any inquiries, please contact us.

4. Orders

Orders can be placed via the website, email, phone, or WhatsApp. No minimum order value is required. Customers must follow specific instructions for customizing jewelry when applicable.

By placing an order, you declare that:

You are at least 18 years old and have the legal capacity to place and fulfill any order, or you possess parental authorization to do so and can provide proof upon request.

You are acting as an individual for personal purposes, meaning any order must align with the normal needs of a private individual.

Ethelya is only bound to fulfill an order upon receipt of an acknowledgment and payment. We reserve the right to cancel or reject orders for legitimate reasons, particularly in cases of suspicion or disputes related to previous orders.

Our product offers and prices are subject to availability. If any items you have ordered are unavailable, we will substitute them with products of equal or higher quality at no additional cost. You will be informed of any unavailability, given a revised delivery timeframe, and provided with the option to cancel your order.

Ethelya may cancel orders due to supplier issues or force majeure. In such cases, we will notify you promptly and refund any amounts paid.

5. Delivery

Standard delivery times are four (4) weeks. We partner with various carriers for delivery, which is free of charge. We do not offer express or premium delivery and do not ship internationally.

If the package appears damaged or tampered with, you must refuse it and notify us by providing:

(a) a sworn statement acknowledging receipt of a damaged or tampered package,

(b) a copy of valid identification, and

(c) proof of residence dated within the last three months.

Ownership and risk transfer upon delivery. However, if:

Your package is returned due to an incorrect address, failure to claim it, or inability to contact you, AND

We cannot reach you for three months,

Ethelya retains ownership of the products and may freely dispose of them. Payments made for such products will not be refunded.

For disputed deliveries or damaged goods, you must provide a sworn statement, proof of identity, and proof of residence before a replacement can be sent.

6. Returns and Refunds

You have up to thirty (30) days from delivery to request a return or exchange for a product that does not meet your satisfaction. Personalized items are not eligible for return unless there is a manufacturing defect.

Returned products must be in their original condition, unused, and accompanied by all original packaging and documents. Return shipping costs are borne by the customer. Refunds will be processed after verifying the returned product's condition.

7. Warranty and After-Sales Service

Ethelya provides a warranty against defects in conformity and hidden defects as per French law (Articles 1641–1649 of the Civil Code). This warranty extends indefinitely for products used under normal conditions.

8. Liability

Ethelya is not responsible for damages caused by misuse of the product. Non-conformity claims must be made within seven (7) days of delivery.

9. Personal Data and Privacy

Customer data is collected solely for order processing and internal marketing. Data is not shared with third parties without explicit consent.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by French law. In case of disputes, customers may choose to bring claims before the competent courts in the jurisdiction of delivery or Ethelya's registered office.

11. Modifications

Ethelya reserves the right to modify these Terms and Conditions at any time. Changes will apply upon publication on the website.
